Acceptance of the terms
By creating an account, downloading the app, browsing our website or otherwise using TiloTrack, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy.
If you use the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
What TiloTrack is
TiloTrack is an iOS fitness app that helps users track training, body data, progress, nutrition and macros, workout plans, achievements and trainer/client collaboration features.
TiloTrack is currently an early-stage product. We may add, remove, improve, delay or change features at any time.
TiloTrack does not currently offer subscriptions, in-app purchases or a trainer marketplace. If we add paid features later, additional pricing and billing terms may apply.
Account eligibility and registration
You may use TiloTrack only if you are at least 16 years old, or older if required by the law where you live, and legally able to accept these Terms.
You agree to provide accurate registration information and to keep your account credentials secure. You are responsible for activity that occurs under your account unless you promptly notify us of unauthorized access.
User responsibilities
- Use TiloTrack in compliance with these Terms and applicable laws
- Provide accurate information to the extent you choose to log it
- Review your workouts, goals and trainer interactions carefully
- Train safely and within your own abilities and medical constraints
- Stop activity if you feel pain, dizziness, illness or other warning signs
- Respect trainers, clients and other users in collaborative features
- Maintain the confidentiality of your login credentials
- Promptly report security concerns or suspected misuse
Acceptable use
You agree to use TiloTrack responsibly and only for lawful purposes. You may not:
- Use TiloTrack for unlawful, harmful, fraudulent or abusive purposes
- Impersonate another person or misrepresent your identity, credentials or role
- Upload malware, malicious code, spam or harmful content
- Interfere with the security, integrity or normal operation of the service
- Scrape, copy, reverse engineer or attempt to extract source code except where the law clearly allows it
- Use the service to harass, threaten or abuse other users
- Infringe intellectual property, privacy or other rights
Fitness and health disclaimer
TiloTrack is provided for general fitness, self-tracking and informational purposes only. It helps athletes and trainers record activity, review progress and work together more effectively.
TiloTrack is not medical advice, medical care, diagnosis or treatment. It is not a medical device unless we clearly state otherwise.
TiloTrack does not guarantee fitness results, weight loss, muscle gain or any specific health outcome. Physical training involves risk. You are responsible for exercising sound judgment and training within safe limits.
Always use your own judgment before starting, stopping or changing exercise, training, recovery, nutrition or weight-management activities. If you have a medical condition, injury, symptoms or health concerns, consult a qualified physician or other licensed healthcare professional before acting on information from the app.
If you think you may be having a medical emergency, do not rely on TiloTrack. Contact emergency services or a qualified medical professional immediately.
Trainer and client features
TiloTrack may allow trainers, coaches or clients to connect and share plans, progress, notes and related information.
Unless we explicitly state otherwise:
You are responsible for deciding whether a workout, plan or recommendation is appropriate for you.
- TiloTrack is only a software tool
- Trainers and coaches are independent users of the platform, not our employees, agents or medical providers
- We do not guarantee any trainer's qualifications, certifications, licensing, experience, suitability or results
- Any training, coaching or fitness advice you receive through the app is followed at your own risk
- Any separate relationship, agreement or arrangement between you and a trainer outside TiloTrack is your responsibility, not ours
No medical advice
Content in the app, including nutrition summaries, progress views or future insight features, is for informational and organizational purposes only.
Consult a qualified healthcare professional before starting or changing any exercise, nutrition, weight-loss or rehabilitation program, especially if you have a medical condition, injury, pregnancy or other health concern.
User-generated data and content
You retain ownership of the content and data you submit to TiloTrack, including workout records, body data, nutrition data, notes and plan-related content.
You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, adapt and display that content only as needed to operate, maintain, secure, improve and provide TiloTrack to you.
If you provide suggestions, ideas or feedback about TiloTrack, we may use them without restriction or compensation to you.
Intellectual property
TiloTrack, including its software, branding, design, documentation, website content and exercise library materials we provide, is protected by intellectual property laws.
Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell or create derivative works from our materials.
We give you a limited, personal, non-exclusive, non-transferable, revocable right to use TiloTrack for its intended purpose and subject to these Terms.
Third-party services
TiloTrack may integrate with or link to third-party services such as authentication providers, app stores, analytics tools or external forms. Those services are governed by their own terms and privacy practices.
We are not responsible for third-party services we do not control.
Availability and product changes
TiloTrack is provided on an "as available" basis. We aim to keep the service reliable, but we do not guarantee uninterrupted, secure or error-free operation.
Maintenance, updates, outages or changes in third-party infrastructure may affect availability. Because TiloTrack is an evolving MVP product, some features may change or be discontinued.
Where practical, we will communicate significant changes through the app, website or other reasonable channels.
Account suspension and termination
You may stop using TiloTrack at any time and may request account deletion as described in our Privacy Policy.
We may suspend or terminate access if you materially breach these Terms, create risk for other users or the service, we suspect fraud or abuse, or where required by law.
If your account is terminated, provisions that by their nature should continue will remain in effect, including intellectual property, disclaimers, limitation of liability and dispute-related terms.
Disclaimers
To the fullest extent permitted by applicable law, TiloTrack is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied or statutory.
We do not guarantee any fitness outcome, body change, performance improvement or coaching result, or that workouts, plans, charts, progress metrics or other outputs will always be complete, accurate or suitable for you.
Limitation of liability
To the fullest extent permitted by applicable law, ANTON FAIBYSHEV FOP and its affiliates, directors, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill or other intangible losses, arising from your use of or inability to use TiloTrack.
Our total liability for claims arising out of or relating to TiloTrack will not exceed the greater of the amount you paid us for the service in the twelve months before the claim or 100 EUR.
Nothing in these Terms excludes or limits any liability or consumer rights that cannot be excluded or limited under applicable law.
Governing law and disputes
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply.
Any disputes will be handled in the courts of Kharkiv, Ukraine, unless applicable law gives you the right to bring claims elsewhere.
Disputes should first be raised with us at [email protected] so we can attempt to resolve them informally.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide additional notice in the app, on the website or by email.
Continued use of TiloTrack after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you should stop using the service.
